Spark is pleased to announce the publication of the ‘Compendium of EURATOM relevant CJEU cases’ it has compiled for DG ENER.
The Compendium provides comprehensive and user-friendly insight and guidance into the interpretation and application of the Euratom Treaty, which governs the functioning of the civil nuclear sector. Even though the Euratom Treaty has largely remained unchanged since its signature in 1957, it remains a living document, as its scope and interpretation have evolved through a series of landmark judgments from the Court of Justice of the European Union.
The Compendium maps these judicial developments, reflecting upon their impact on the Euratom regulatory framework. It provides structured guidance on the theoretical and practical implications of the Court’s decisions. Moreover, the Compendium weaves in relevant insights from the academic literature, providing a comprehensive outlook on the evolving nature of the Euratom framework.
The Compendium follows the structure of the Euratom Treaty, providing insight into the interpretation of each of its articles separately. Particular attention is given to key areas: the extension of competences of the Euratom Community and the limits of the scope of the Treaty, and the evolving relation between the Euratom Treaty and the European Union legal framework.
