Publication of the study on supporting the identification of professions

Spark Legal and Policy Consulting, together with 3s Unternehmensberatung GmbH, is pleased to announce the publication of the Study supporting the identification of professions for the extension of automatic recognition through common training frameworks under Directive 2005/36/EC, carried out for the European Commission’s Directorate-General for Employment, Social Affairs and Inclusion (DG EMPL).

Common Training Frameworks (CTFs), provided for under Article 49a of Directive 2005/36/EC, are a mechanism aimed at facilitating professional mobility within the Single Market. By establishing a common core of minimum knowledge, skills and competences across at least one-third of EU Member States, CTFs could enable professionals meeting those requirements to benefit from the automatic recognition of their professional qualifications without having to undergo additional compensatory measures.

The study pursued two main objectives: first, to identify professions that could potentially be suitable for the development of CTFs; and second, to assess for which professions the development of a CTF appears most feasible, based on existing commonalities across Member States, and to outline the elements that potential future frameworks could include. The study provides preliminary analytical elements intended to support further reflection and inform possible future initiatives in this area, rather than preparing or drafting CTFs themselves.

The publication is particularly timely in the context of the European Commission’s recently adopted Fair Labour Mobility package, which includes measures aimed at improving the recognition and portability of qualifications across the EU. As part of the package, the Commission has proposed updating the rules on the recognition of professional qualifications and extending automatic recognition through common training frameworks to additional regulated professions.
